IPOH, July 29 – A food delivery boy was charged again in Sessions Court here today with raping a schoolgirl two weeks ago.
Afiq Yan Muhammad Farid Yan, 20, was charged with raping the 15-year-old girl in a bedroom of a house in Jalan Felda Lasah, Kampung Pulau Mentimun, Sungai Siput Utara, between 1 a.m. and 2 a.m. on July 17.
The charge, made under Section 376 of the Penal Code, carries a maximum prison term of 30 years and flogging, on conviction.
The man yesterday pleaded not guilty to committing the same offense against the same girl at a hotel here around midnight on July 16.
Meanwhile, in the same court, two men, namely Muhammad Azeem Abdul Rahman, 20, Mohamad Ariff Haikal Arapin, 21, and a boy, 18, were charged with gang raping the same victim in a house no number to Taman Dovenby. , Sungai Siput Utara, between 1 a.m. and 2 a.m. on July 14.
The offense under Section 375B of the Penal Code is punishable by imprisonment for a minimum of 10 years and a maximum of 30 years, on conviction.
However, all four pleaded not guilty after the charge against them was read before Judge Ainul Shahrin Mohamad.
Deputy Prosecutor Nur Asmaniza Muhamad prosecuted the two cases while the defendants were represented by attorneys Navin Punj, Mahajoth Singh and S. Sundarajan.
Ainul Shahrin granted Afiq Yan bail of RM8,000 with bail, and Muhammad Azeem along with Mohamad Arif Haikal got bail of RM10,000, while the boy was allowed to be released on bail of RM5,000 . The cases were set for mention on September 2.
Earlier, a 16-year-old girl who is also a friend of the victim pleaded not guilty in the Kuala Kangsar Magistrate’s Court to encouraging Muhammad Azeem, Mohamad Ariff Haikal and the boy to rape the girl between 1 a.m. and 2 a.m. on July 14.
She was charged under Article 375B of the Penal Code read in conjunction with Article 109 of the same code which provides for a minimum prison term of 10 years and a maximum of 30 years if convicted.
The teenager was also charged with encouraging Afiq Yan to commit the offense on July 17 under Article 376 of the Penal Code read in conjunction with Article 109 of the same code which provides for a minimum prison sentence of 10 years and maximum 30 years and flogging, on conviction.
The court granted the girl bail of RM2,000 for each charge and ordered her not to disturb the victim and to report to the nearest police station once a month.
The court fixed August 5 for mention.
