Accident claims: does third-party insurance cover the passenger? Supreme Court returns case to broader panel

The Supreme Court bench comprising Justices Hemant Gupta and Vikram Nath while considering a claim raised in a motion for special leave that a motorcycle passenger is not a third party, therefore, the insurance company is not not liable to indemnify the insured because of the injury or death of such a passenger, referred these matters to a broader bench. Initially, passengers are not even covered by car insurance. From now on, within the framework of civil liability insurance, the passenger of a motorcycle can make a complaint and ask for compensation if he is injured during the accident of the two-wheeler.
